Trademark strategy, filing, and enforcement in Germany, the European Union, and internationally.

Whether you need to register a national trademark, an EU trademark, or an international mark, IVANOV.LAW provides comprehensive legal support. We represent you before the German Patent and Trademark Office (DPMA), the European Union Intellectual Property Office (EUIPO), and the World Intellectual Property Organization (WIPO).

Attorney Ivanov is a certified specialist in intellectual property law with extensive experience in trademark filing, enforcement, and litigation.

We offer legally sound, strategic solutions tailored to your business goals.

Trademark Services With Strategic Depth

We advise from the earliest brand decision through to ongoing legal protection. That includes legal assessment of registrability, filing strategy, office representation, and later portfolio management once a mark is on the register.

  • German trademark registration (DPMA): Advice on suitable sign selection, class strategy, application drafting, filing, and communication with the office.
  • EU trademark registration (EUIPO): Preparation and filing of EU-wide applications for businesses seeking protection across the internal market through one central right.
  • International registration (WIPO): Structuring and extending protection to selected jurisdictions under the Madrid System based on a German or EU base application or registration.
  • Opposition and conflict assessment: Review of relative risks, earlier rights, and practical collision issues before filing or during contested proceedings.
  • Portfolio and deadline management: Monitoring of renewal deadlines, portfolio structure, and legal maintenance of trademarks used across products, regions, and companies.
  • Trademark licensing and commercialization: Drafting and reviewing license agreements, coexistence agreements, assignments, and other arrangements involving the economic use of a brand.
  • Infringement and enforcement: Cease and desist strategy, warning letters, injunction-related action, defense against claims, and representation in court if required.
  • Use and compliance advice: Guidance on genuine use, proof of use issues, branding rollouts, marketing claims, packaging, websites, and online shop presentation.

Representation Before the Relevant Offices

Objections, formal deficiencies, class questions, and conflicts with earlier rights can determine whether an application becomes a useful right or an expensive dead end. We represent clients before the DPMA, EUIPO, and WIPO and handle the legal communication needed to move matters forward efficiently.

This is particularly important for businesses filing from abroad, companies entering the German market, and founders who need reliable legal support without building an internal trademark function. We translate legal and procedural issues into clear recommendations and handle the formal side with precision.

From Filing to Long-Term Brand Protection

Trademark protection should match the life cycle of the business. In some cases the right first step is a focused German filing. In others, EU-wide protection or a coordinated international strategy makes more sense from the outset. We help clients avoid overbroad, underprotected, or commercially unrealistic filings and instead build protection that can actually be used and defended.

Frequently Asked Questions

How much does trademark registration cost?

The total cost depends on the filing route, the number of classes, and the scope of legal work. A German application differs materially from an EU or international registration. We explain both the official fees and our legal fees transparently before filing.

How long does the registration process take?

DPMA (German trademark): approx. 3–6 months. An EU trade mark application must first be examined and published. A three-month opposition period then follows before the mark can be registered. Objections or an opposition will extend the process. International registration (Madrid Protocol): once the international registration has been recorded, the offices of the designated countries examine protection under their own law. For notifying a provisional refusal they generally have 12 or 18 months from the date WIPO notifies them; the actual timeline depends on the country and on any objections raised.

Should I file in Germany, the EU, or internationally?

That depends on where you actually do business, where expansion is planned, and how important your brand is to the company. The best route is a strategic decision, not a standard package. We assess the practical business case and recommend the appropriate filing structure.

What happens if someone infringes my trademark?

We assess the infringement, the strength of your position, and the commercially sensible next step. Depending on the case, that may involve a warning letter, negotiation, interim relief, or court proceedings. Fast reaction is often important because delay can weaken leverage.
